Silence for Health: DC Shopian Imposes Two-Month Ban on Loudspeakers/Amplifiers

In a move aimed at restoring environmental balance and public tranquility, the District Magistrate Shopian, Shishir Gupta, IAS has imposed a complete ban on the use of loudspeakers, amplifiers, public address systems and microphones in markets and public spaces across the district for a period of two months.

The order, issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, declares excessive noise pollution a public nuisance, citing its adverse impact on public health, peace and the right to a wholesome environment.

According to the district administration, repeated complaints and on-ground observations revealed that uncontrolled use of sound-amplifying devices by shopkeepers, hawkers and vendors primarily for commercial advertising had turned marketplaces into zones of constant noise, causing distress to residents, shoppers and visitors alike.

The order also flags vehicles such as vans, auto-rickshaws and handcarts fitted with loudspeakers for promotional announcements as a major contributor to rising noise levels, affecting both residential and commercial localities. Unregulated use of horns, generator sets, construction machinery and sound systems during social or religious gatherings beyond permissible limits has also been categorised as a public nuisance.

Invoking Article 21 of the Constitution, the District Magistrate underscored that the right to life includes the right to live in a clean and peaceful environment, free from hazardous noise pollution. Accordingly, the use of sound-amplifying equipment for advertising or selling goods has been strictly prohibited, with directions for immediate removal or disconnection of such devices.

The order further bans the use of vehicles mounted with loudspeakers for announcements, music or advertisements unless permitted under existing rules.
For effective enforcement, the Senior Superintendent of Police, Shopian, has been tasked with ensuring strict implementation.

Police officials have been authorised to seize loudspeakers, amplifiers and microphones found in violation, while Tehsildars and Sub-Divisional Magistrates have been directed to act swiftly on public complaints. Municipal authorities have been instructed to widely publicise the order and ensure compliance.

The ban will remain in force from January 1 for two months, unless withdrawn earlier. Authorities have warned that any violation will invite strict action under relevant provisions of law.
